Besides the most common concern of a large fine and points, traffic tickets can also carry many more serious consequences such as suspension of driving privileges, exorbitant insurance increases and even the possibility of jail.
Points for traffic tickets range from 2 points for certain violations, up to 11 points. Keep in mind, many tickets do not carry points but still carry serious penalties that may result in excessive fines, a suspension of your driving privileges or increase in your insurance premiums.
Additionally, certain traffic violations are quasi-criminal, which mean you will have a criminal record should you be convicted of them.
New York State Traffic Violations & Penalties
Driver Responsibility Assessment (DRA)
Applies to all drivers even if they do not hold a NY license.In addition to any fines imposed by the Court, New York State imposes a surcharge when you accumulate 6 or more points within an 18 months period and for other serious traffic offenses.
The surcharge is $300 for the first six points and $75 for each additional point. This can be paid over three years or in one lump sum. The surcharge is $750 if you are convicted of a drug or alcohol driving-related offense or refusal to submit to a chemical test. A $750 civil penalty will be imposed for a conviction of driving without insurance.
Suspensions & Revocations
Your drivers license or your privilege to drive in New York State will be suspended if you receive 11 points within any 18 month period. After the suspension period you would pay a fee to reinstate your ability to drive
Accumulating 3 speeding tickets within any 18 month period will result in a revocation of your driving privileges. At the end of the revocation period you need to reapply to obtain back the privileges to drive; it is not something that happens automatically by paying a reinstatement fee.
Defensive Driving Courses
DD courses (which can be completed in person or online) will count as a 4 point ‘credit’ towards license suspension, provided they are completed within the proper timeframe. While these do not technically ‘remove’ points from your drivers abstract, they will allow for the additional accumulation of points before a license suspension is issued.
In essence, you would be able to accumulate 15 points before being subject to a suspension.
However, a Judge may still issue a suspension regardless of whether NY State chooses to issue a suspension.
